1. Definitions

• "Kinwell" / "we" / "us" / "our" refers to Kinwell, located at 117 Klang Mueang Road, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand.
• "Services" refers to Kinwell's three offerings: Quiet Conversation Hours (lounge room hire), Communication Skills Course, and Family Records Companion.
• "User" / "you" refers to any individual who contacts Kinwell, makes a booking, attends a session, or uses this website.
• "Booking" refers to a confirmed reservation for any of Kinwell's services.
• "Agreement" refers to these Terms and Conditions together with any booking confirmation.
• "Website" refers to kinwell.cyou and all pages under that domain.

2. Acceptance of Terms

By submitting an enquiry, making a booking, or using this website, you confirm that you have read and agree to these Terms and Conditions.

You must be at least 18 years of age to book or use Kinwell's services. By making a booking you confirm you meet this requirement and have the legal capacity to enter into this agreement.

If you are booking on behalf of a group (for example, a family), you confirm you have the authority to do so and that all attendees are aware of and bound by these terms.

3. Service Description

Kinwell provides the following services from its premises at 117 Klang Mueang Road, Khon Kaen:

• Quiet Conversation Hours: A two-hour room hire in a furnished lounge setting for up to eight people. Includes refreshments and a steward available on request. No facilitator is present unless specifically requested.
• Communication Skills Course: A four-session educational course covering listening, paraphrasing, structured disagreement, and summarising. Provided on an educational basis only; does not constitute psychological, legal, or therapeutic services.
• Family Records Companion: A six-month package involving one monthly administrative visit to a single household to update and index a shared records folder. Purely administrative; the assistant does not interpret document content.

Services are available in Khon Kaen Province, Thailand. Kinwell reserves the right to limit availability during public holidays or periods of reduced staffing.

4. User Responsibilities

When using Kinwell's services, you agree to:

• Treat the lounge, its furnishings, and Kinwell staff with respect
• Arrive at the agreed time; late arrivals do not extend the booking period
• Not use the lounge room for purposes that are unlawful, abusive, or disruptive to other users of the premises
• Not record audio or video in the lounge without the written consent of all other persons present
• Provide accurate contact details when making a booking
• Notify Kinwell of any changes to the number of attendees at least 24 hours in advance

Kinwell reserves the right to end a session early if conduct is unsafe, abusive, or unlawful. In such cases, no refund will be issued.

5. Intellectual Property

All content on this website — including text, design, and course materials — is the property of Kinwell unless otherwise noted. You may not reproduce, distribute, or adapt this content without written permission.

The communication course curriculum draws on publicly available educational frameworks. Kinwell does not claim proprietary ownership over those source materials but does hold rights over the specific course structure, session outlines, and exercises as assembled and adapted by Kinwell.

6. Payment Terms

All prices are quoted in Thai Baht (฿). Current prices are:

• Quiet Conversation Hours: ฿3,600 per two-hour room booking
• Communication Skills Course: ฿4,800 per participant (all four sessions)
• Family Records Companion: ฿17,400 per six-month household package

Payment is due at or before the first session of each booking, unless otherwise agreed in writing. Kinwell accepts bank transfer and cash. A confirmation will be sent upon receipt of payment.

Cancellations: Cancellations made more than 48 hours before a lounge session receive a full refund. Cancellations within 48 hours are non-refundable. For the course, a full refund applies if cancellation is made before Session 1; no refund after Session 1 has been attended. For the Records Companion, a pro-rated refund applies for months not yet commenced.

7. Scope of Services — Important Limitations

Kinwell's services are venue hire, education, and administrative support. They are not and should not be understood as:

• Legal advice, legal representation, or mediation as defined under Thai law
• Psychological counselling, psychotherapy, or mental health services
• Financial advice or accounting services
• Any regulated professional service

If you require any of the above, Kinwell will be glad to suggest appropriate directions, but cannot provide those services itself.

8. Disclaimers

Kinwell's services are provided on an "as available" basis. We do not give any undertaking that use of our services will achieve a particular outcome for you or your family. The communication course teaches skills that may be useful in many contexts; we do not represent that completing the course will resolve any specific situation.

The Records Companion provides administrative organisation. We do not warrant the legal validity, accuracy, or completeness of any documents placed in your records folder.

9. Limitation of Liability

To the extent permitted by Thai law, Kinwell's total liability to you for any claim arising from a booking shall not exceed the amount paid for that booking.

Kinwell is not liable for any indirect, consequential, or special losses. Kinwell is not responsible for the content of conversations held in the lounge or for any decisions made by attendees during or after a session.

10. Indemnification

You agree to indemnify Kinwell against any claims, costs, or damages arising from your breach of these Terms, your misuse of the premises, or any unlawful conduct during a session.

11. Termination

Either party may end a service arrangement with reasonable written notice. Kinwell may terminate a booking immediately if you breach these Terms or if continued service would require Kinwell to act outside its stated scope.

Sections 7, 8, 9, 10, 12, and 13 of these Terms survive termination.

12. Dispute Resolution

In the event of a dispute, we ask that you first contact us at [email protected] to seek an informal resolution. We aim to respond within five working days.

If informal resolution is not possible, disputes shall be governed by Thai law and subject to the jurisdiction of the courts of Khon Kaen Province, Thailand.

13. General Provisions

• Entire Agreement: These Terms, together with any booking confirmation, constitute the full agreement between you and Kinwell.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce a provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under this Agreement without Kinwell's written consent.
• Notices: Formal notices should be sent by email to [email protected] or by post to the address below.

14. Changes to These Terms

Kinwell may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect any changes. For bookings already confirmed at the time of an update, the prior Terms apply unless you accept the updated Terms.
